TERMS OF SERVICE

Bilstein-Shocks.co.uk — Operated by Sourcefy LTD

1. Overview

This website is operated by Bilstein-Shocks.co.uk, a trading name of Sourcefy LTD ("we", "us", "our"). Throughout the site, the terms "we", "us" and "our" refer to Bilstein-Shocks.co.uk.

Important:Bilstein-Shocks.co.uk is an independent retailer of Bilstein-branded products. We are not owned, operated by, or affiliated with ThyssenKrupp Bilstein GmbH or any of its subsidiaries. All references to "Bilstein" on this website refer to the manufacturer’s products that we resell.

By accessing our website or purchasing from us, you agree to be bound by these Terms of Service ("Terms"), together with our Returns Policy, Warranty Policy, and Privacy Policy, each of which is incorporated by reference. If you do not agree, you must not use our website or place an order.

These Terms apply to all users of the site, including browsers, customers, vendors, and contributors of content.

2. Our Commitment

We aim to provide accurate product information, genuine products, and a fair purchasing experience. Where something goes wrong, we will work with you to resolve it in line with these Terms and your statutory rights as a UK consumer.

3. Eligibility & Use

By placing an order or using this site, you confirm that:

      You are at least 18 years old and legally capable of entering into a binding contract;

      You will not use our products or this website for any unlawful or unauthorised purpose, nor will you violate any laws in your jurisdiction;

      You will not attempt to gain unauthorised access to the site, introduce malicious code, or interfere with its operation;

      You will not reproduce, duplicate, copy, sell, or resell any part of the website or its content without our prior written consent.

A breach of any of these conditions may result in immediate suspension or termination of your access to our Services.

4. Product Information & Accuracy

We make every reasonable effort to ensure that product descriptions, compatibility data, pricing, and availability are accurate and up to date.

You should be aware that:

      Product images are for illustration purposes only and actual products may vary in minor cosmetic detail;

      Compatibility data is provided as a guide and should be verified against your specific vehicle before purchase or installation;

      The site may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, or availability.

Where an error is identified, we reserve the right to correct it and, where necessary, to cancel affected orders prior to dispatch in accordance with Section 5. Your statutory rights are unaffected.

5. Orders & Contract Formation

All orders placed through this website constitute an offer to purchase, subject to acceptance by us.

      Order acknowledgment is not acceptance.The order confirmation email you receive after checkout is an acknowledgment that we have received your order — it does not constitute acceptance of your offer or the formation of a contract.

      Contract formation.A contract between you and us is formed only when we send you a dispatch confirmation email for the relevant item. Where an order contains multiple items, a separate contract is formed in respect of each item upon its dispatch.

      Right to refuse or cancel.We may decline or cancel an order, in whole or in part, at any time prior to dispatch where:

      a pricing, product, or listing error is identified;

      the product is unavailable or out of stock;

      we reasonably suspect fraud, misuse, or breach of these Terms;

      vehicle compatibility cannot be verified (see Section 7);

      the order quantity exceeds our published per-customer limits, or the order is reasonably believed to be for unauthorised resale.

Where we cancel an order prior to dispatch, you will receive a full refund of any sums paid in respect of the cancelled items. We will not be liable for any further loss arising from the cancellation.

6. Pricing & Payment

      Prices are displayed in GBP and include VAT where applicable, unless otherwise stated.

      Delivery charges, where applicable, are additional and shown at checkout before order completion.

      Prices may change without notice prior to order acceptance. Once a contract is formed under Section 5, the price applicable to the dispatched item will not change.

      Payment must be received in full and cleared funds before any order is dispatched.

Manifest pricing errors.Where a product is displayed at a price that is obviously incorrect (for example, due to a system error or mispriced listing) and the error could reasonably have been recognised by you as a mistake, we reserve the right to cancel the order and issue a full refund, even after order acknowledgment.

7. Vehicle Compatibility & Verification

Many automotive parts require precise vehicle-level compatibility verification.

      We may request your vehicle registration number, VIN, or other identifying information before dispatch in order to confirm fitment.

      Where we request this information and it is not provided, or is provided incompletely, we may pause or cancel the order to avoid a "not as described" outcome.

      Customer responsibility.You are responsible for ensuring that the part you order is correct for your vehicle. Where you have provided complete and accurate vehicle information and the part is subsequently confirmed incompatible, we will treat this as a "not as described" matter under Section 9.2.

      Customer error.Where you have provided incomplete, inaccurate, or no vehicle information, and a fitment issue arises as a result, the matter will be treated as a change-of-mind return under Section 9.1, and return shipping costs will be your responsibility.

8. Delivery

      Estimated delivery times are provided in good faith but are not guaranteed and do not form part of the contract unless expressly stated.

      Risk and title.Risk of loss or damage passes to you when the goods are delivered to the address you provided at checkout. Title to the goods passes to you when we have received payment in full.

      Delivery address accuracy.You are responsible for ensuring that the delivery address provided is accurate and complete. We are not liable for non-delivery, delay, or loss arising from incorrect address details.

      Failed or refused delivery.Where a delivery fails because no one is available to receive it, the address is incorrect, or the parcel is refused, any redelivery, return-to-sender, or storage costs charged by the courier may be passed on to you.

      International orders.Where we dispatch to an address outside the United Kingdom, you are responsible for any import duties, taxes, customs clearance fees, and local handling charges. We have no control over these charges.

9. Returns & Cancellations

9.1 Change-of-Mind Returns (Distance Selling)

Under the Consumer Contracts Regulations 2013, you have the right to cancel a consumer order without reason within 14 days of receiving the item.

      Notification.You must notify us of your intention to cancel within 14 days of receiving the goods.

      Return window.You then have a further 14 days from the date of notification to return the item to us.

      Refund scope.We will refund the full product price and the cost of standard outbound delivery. Where you selected an express, premium, or expedited delivery option, only the equivalent of our standard delivery charge will be refunded.

      Return shipping.You are responsible for the cost of returning the item to us.

      Condition of items.Items must be unused, uninstalled, and in resellable condition with original packaging intact. You may handle and inspect the item only as you would in a physical shop.

      Fitted parts.Suspension components that have been fitted to a vehicle, partially fitted, or otherwise mounted, bolted, or installed are deemed to have been used beyond inspection. Such items are not eligible for change-of-mind return.

      Diminished value.Where an item is returned showing signs of use, handling, or installation beyond what is necessary to establish its nature, characteristics, and functioning, we reserve the right to deduct an amount from your refund to reflect the loss in value, up to the full product price.

      Right to refuse.We reserve the right to refuse returns that do not meet the conditions of this section.

9.2 Faulty or Not as Described

Where an item is faulty, not as described, or is confirmed incompatible with the vehicle for which complete and accurate vehicle information was provided at the time of order, you are entitled to a remedy in accordance with the Consumer Rights Act 2015.

      We may offer repair, replacement, or refund as appropriate, in line with your statutory rights.

      We may request photographs, video, or other reasonable evidence of the fault, and may require physical inspection of the item before confirming the outcome.

      Where a fault is confirmed, we will bear the necessary costs of return shipping for UK customers, in accordance with our statutory obligations.

      International orders.For orders shipped to addresses outside the United Kingdom, all return shipping costs, duties, taxes, and handling charges remain the customer’s responsibility, regardless of the inspection outcome.

      Customer error.Where inspection establishes that the issue is due to misuse, incorrect installation, customer-error fitment selection, or other non-defect causes, the matter will be treated under our change-of-mind policy in Section 9.1.

9.3 Marketplace Purchases

These Terms apply to direct purchases made through Bilstein-Shocks.co.uk. Where you purchased our products through a third-party marketplace (such as eBay or Amazon), the marketplace’s own terms govern the transaction, in addition to any non-excludable rights under UK law.

10. Warranty

All products purchased through Bilstein-Shocks.co.uk include a 2-year manufacturer’s warranty against defects in materials and workmanship, valid from the date of purchase.

The full terms, exclusions, and process for warranty claims are set out in our separate Warranty Policy, which forms part of these Terms.

      Manufacturer assessment.Warranty claims require physical inspection by the manufacturer’s technical centre. The outcome of that inspection determines whether a claim is approved under the manufacturer’s warranty.

      Statutory rights.The manufacturer’s warranty operates alongside, and in addition to, your statutory rights as a UK consumer against us as the retailer under the Consumer Rights Act 2015. Nothing in the warranty process limits those statutory rights.

      Third-party costs.In line with the manufacturer’s terms, the warranty does not cover third-party costs including labour, removal, installation, recovery, or loss of use, except where required by UK law.

11. Product Use & Installation

      You are responsible for ensuring that any product purchased is correctly installed in accordance with the manufacturer’s specifications.

      We strongly recommend that suspension components are fitted by a qualified mechanic using the correct tools, torque specifications, and ancillary components (including bump stops, dust covers, and top mounts where applicable).

      Products are intended for standard road use on the vehicle applications listed by the manufacturer, unless explicitly designated for a different application.

      We are not liable for losses arising from improper installation, fitment to incorrect or unlisted vehicle applications, or use outside the product’s intended specification.

12. Fraud, Abuse & Order Protection

To protect customers, our business, and our suppliers, we reserve the right to refuse, cancel, suspend, or limit any order or account where we reasonably suspect:

      Fraudulent payment activity or identity misuse;

      Abuse of our returns, refunds, or warranty policies;

      Unauthorised commercial resale;

      Provision of false, incomplete, or misleading information;

      Attempts to circumvent per-customer or per-order limits.

13. Chargebacks & Dispute Resolution

We are committed to resolving issues quickly and fairly. Before initiating a chargeback or payment dispute with your bank or card issuer, please contact us at support@bilstein-shocks.co.uk so that we have the opportunity to resolve the matter directly.

Initiating a chargeback for a matter that has not first been raised with us, or that is subsequently determined to be invalid, may delay refunds you are otherwise entitled to and may result in suspension of your account.

Nothing in this section limits your right to use the bank or card-issuer dispute process, or any external dispute resolution scheme available to UK consumers.

14. Third-Party Services & Links

The website may contain links to, or integrate with, third-party tools, services, or websites that we do not own or control. We provide these for convenience only.

      We are not responsible for examining or evaluating the content, accuracy, or practices of third-party sites or tools.

      We have no liability for any loss or damage arising from your use of third-party services accessed through this website.

15. Intellectual Property

All content on this website, including text, layout, graphics, logos, and product imagery created by us, is owned by or licensed to Sourcefy LTD. The "Bilstein" name and associated trademarks remain the property of their respective owners. You may not reproduce, copy, distribute, or commercially exploit any part of this website without our prior written permission.

User submissions, including reviews, comments, and feedback, may be edited, copied, published, and distributed by us in connection with the operation of the website, without restriction or obligation to compensate you.

16. Privacy & Data Protection

Your personal information is processed in accordance with our Privacy Policy, the UK General Data Protection Regulation (UK GDPR), and the Data Protection Act 2018. Please refer to our Privacy Policy for full details of how we collect, use, store, and protect your personal data.

17. Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

      death or personal injury caused by our negligence;

      fraud or fraudulent misrepresentation;

      any liability that cannot be excluded or limited under UK law, including under the Consumer Rights Act 2015.

Subject to the above, and to the fullest extent permitted by law:

      We are not liable for indirect, consequential, or special losses, including loss of profit, loss of business, loss of opportunity, or loss of use;

      Our total aggregate liability arising out of or in connection with any product purchased through this website is limited to the price paid by you for that product.

18. Force Majeure

We are not liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events outside our reasonable control, including but not limited to:

      acts of God, natural disasters, fire, flood, or extreme weather;

      war, terrorism, civil unrest, or government action;

      supply chain disruption, manufacturer delay, or import/export restrictions;

      failure or delay of couriers, transport networks, or utilities;

      epidemics, pandemics, or public health emergencies.

19. Business Customers

Certain rights set out in these Terms apply only to consumers (as defined under the Consumer Rights Act 2015), including the change-of-mind cancellation rights in Section 9.1.

Where you purchase as a business, in the course of trade, or for the purpose of resale, different terms may apply, and certain consumer-only protections will not be available to you. We may require evidence of your business status, and we reserve the right to apply separate trade terms by agreement.

20. Indemnification

You agree to indemnify and hold harmless Sourcefy LTD, its officers, employees, and affiliates from any claim or demand made by a third party arising from your breach of these Terms or your violation of any law or the rights of a third party.

21. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the remaining provisions shall continue in full force and effect.

22. Termination

Obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. We may terminate your access to the Services at any time for breach of these Terms.

23. Entire Agreement

These Terms, together with our Returns Policy, Warranty Policy, and Privacy Policy, constitute the entire agreement between you and us in relation to your use of this website and your purchase of products from us, and supersede any prior agreements, communications, or representations.

24. Changes to Terms

We may update these Terms from time to time. The version in force at the time of your order is the version that applies to that order. The latest version will always be available on our website, with the "Last updated" date shown at the foot of this page.

25. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, save that consumers resident in Scotland or Northern Ireland may also bring proceedings in their local jurisdiction.
